What Does the Divorce Process Look Like in PA?

The divorce process in Pennsylvania depends on whether the divorce is contested or uncontested. The process could last weeks, months, or at worst, years, especially in contested divorces. To get a better idea of what you may expect in your particular situation, we summarize the general steps in contested and uncontested divorces below:

Contested Divorce Process

  • Filing the Complaint
  • Serving the Complaint within 30 days of filing, or 90 days if the spouse does not live in PA
  • If you and your spouse separated on or after December 5, 2016, you will need to live separate and apart from your spouse for 1 year before filing your Complaint in divorce
  • After living apart for 1 year, either party may sign and file an Affidavit Under Section 3301(d) of the Divorce Code
  • Serve the other party with a Notice of Intention to File the Praecipe to Transmit Record Under Section 3301 (c)(2) or Section 3301 (d) of the Divorce Code to allow them to oppose the divorce
  • 20 days after serving the Affidavit under Section 3301(d) of the Divorce Code with blank Counter-Affidavit, serve the Notice of Intention to File the Praecipe to Transmit Record Under Section 3301 (c)(2) or Section 3301 (d) of the Divorce Code or file Waivers of the Notice of Intent
  • Once the above documents have been properly serviced, the divorce may be concluded by either party filing with the court a Final Praecipe to Transmit Record
  • The Divorce Decree will be mailed to both parties if there are no mistakes on the documents above

Uncontested Divorce Process

  • Filing the Complaint
  • Serving the Complaint within 30 days of filing, or 90 days if the spouse does not live in PA
  • Wait 90 days from the date the Complaint was served to the other spouse before filing the consent forms
  • After 90 days have passed, both parties may file an Affidavit of Consent within 30 days of signing and dating it to declare they consent to the divorce
  • Each party could sign and file a Waiver of Notice or they could mail each other a Notice of Intention to File the Praecipe to Transmit Record Under Section 3301(c)(1) of the Divorce Code
  • The divorce may be concluded when either party files with the court a Final Praecipe to Transmit Record
  • The Divorce Decree will be mailed to both parties if there are no mistakes on the documents above
