Second, the Prior Record Score is based on the prior convictions of the defendant. Based on these two factors, the judge will be provided with a standard range, which the judge can only deviate from if presented with mitigating or aggravating factors.

Mandatory Minimum Sentencing

Some misdemeanor crimes in Pennsylvania require mandatory minimum sentences. For example, operating a motor vehicle without a court ordered ignition interlock system is a third-degree misdemeanor, punishable by a mandatory minimum sentence of ninety days in jail.

Examples of first-degree misdemeanors include indecent assault, possessing an instrument of crime, and endangering the welfare of children. Second-degree misdemeanors can include simple assault, reckless endangerment or the manufacture and sale of false identification. Third-degree misdemeanors can include harassment, disorderly conduct, loitering, prowling or selling liquor to minors.
